Additionally
the exposure to civil litigation and the potential damage to the
client company's image provides even further unacceptable risk.
We are
not against the legal and ethical use of technology, such as
electronic tracking and clandestine video. However, we only
employ these methods in situations which are unquestionably legal,
ethical and in compliance with standards of the industry.
It
should also be noted that some disreputable private investigators
have been known to use electronic tracking devices without the
consent of their clients. Additionally, there have been cases
where clients have looked the other way or instructed their
investigators to get the information on the subject--but not tell
them (the clients) how the information was obtained. As was
shown in the Hewlett Packard case, clients can be held as
responsible as their investigators in such cases. We do not
perform any unusual activities of any sort, without first discussing
it with the client and clarifying the legalities.
The Objective of a
Surveillance:
A perfect surveillance
results when observation of the facility or person for the
designated period is accomplished without having the presence of the
surveillance detected. This is always our sole objective.
Our Surveillance
Methodology:
In most cases, prior to
taking up a surveillance position, we inform the local police of our
approximate anticipated location and the length of time we expect to
be there. This is common courtesy and saves the police from an
unnecessary run. If it appears that a subject being followed
is becoming aware of the surveillance, we drop it at that
point. Continuing to follow subjects who are aware of the
surveillance is of no value whatsoever. Claimants will
exaggerate their alleged disabilities, truck drivers will set new
performance records and thieves will delay their thefts.
Following a subject who is aware of the observation is an amateur's
trait and usually results in a report that contains distortions
engineered by the subject. Additionally, unnecessary exposure
arises since there is a fine line between following, chasing and
even stalking in some venues. Should a subject become involved
in an auto accident during an attempt to elude the surveillance,
liability may be applied to the client, as well as the investigator.
Surveillance Reports:
Our reporting method is not
much different than that used by Timothy Webster, a Union spy
operating during the Civil War. Although this style has been
around since the dawn of the P.I. Business, we believe it can't be
improved upon. Our surveillance reports simply show a time
caption followed by the events which occurred at that time.
The amount of detail contained in the reports varies depending on
the objective of the surveillance. For instance, if the only
objective is to determine where a person goes, the report would be
very brief, showing only two time captions:
8:16 AM:
Rico McPato departed his residence on foot.
9:11 AM: Rico McPato arrived at Fantasialandia.
However, in the case of
an insurance claimant, detail would be provided on the subject's
movements with an eye to any activities inconsistent with the
alleged disability as well as a detailed description of the
claimant, the residence and the vehicle. In the case of a
driver or salesperson, details of the route traveled would be
included, if appropriate, along with comments on speeds driven, et
cetera. We strive to insure our reports contain precise
information applicable to the situation, while excluding irrelevant
detail and inappropriate speculation.
